1.1. Disclaimers and Warranty.
1. IES Warranty – Referenced from IESs current base contract
a. IES Communications. warrants to the original purchaser of IES
Communications. services and equipment provided for the warranty
period of 1 year unless the equipment manufacturer of item/s purchased
and/or installed offer warranty extensions or offer a warranty that is less that
of 1 year. Active components typically are 6 months parts and labor with the
MFG. IES supplied installations and equipment will be free from material
defects and workmanship. Customer must make warranty claims in writing
within fifteen (15) days of the manifestation of a problem. IES
Communications sole obligation under the foregoing warranty is at
IES Communications option, to repair, replace or correct any such
defect that was present at the time of delivery, or to remove the Equipment
and to refund the purchase price to Customer. Parts, labor and shipping costs
not covered by the manufactures warranty including labor diagnose, de-install
and/or re-install equipment shall be an additional cost to the customer at
IES Communications current service rates.
b. The "Warranty Period" begins on the date of installation and/or Customer use
of the supplied item or system whichever comes first unless otherwise
specified by IES Communications.
c. Any repairs under this warranty must be conducted by an authorized IES
Communications. service representative or its approved repair partner.
d. Excluded from the warranty are problems due to accidents, misuse,
misapplication, storage damage, negligence, or modification to the Equipment
or its components.
2. Customer shall be responsible for operation of the Equipment. Customer shall operate the Equipment in a reasonably competent manner and in compliance with the operations manual for the Equipment. Customer shall comply with all applicable rules, laws, and regulations in connection with operation of the Equipment.
3. IES Communications. does not authorize any person or party to assume or create for it any other obligation or liability in connection with the Equipment except as set forth herein.
4. Limitation of Liability. IN NO EVENT SHALL IES COMMUNICATIONS. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, OR USE INCURRED BY CUSTOMER OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT, OR TORT, OR OTHERWISE EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
5. Customer shall request specific manufactures warranty information that may supersede warranty information herein at the time of purchase and have on hand this information at the time of potential future claim to protect themselves upon the event that the MFG changes their policies as they often do at any time.
